Terms & Conditions of Sale

  1.  All goods are sold with an Estimated delivery period. Yorkshire Pergolas shall make all reasonable endeavours to supply the goods within this timescale but may be affected by circumstances outside our control, failure to supply the goods within this period shall not constitute a breach of these terms. Yorkshire Pergolas shall advise you of a delay as soon as reasonably practicable.
  2. Covid 19 and Lockdown – due to the changing situation across the UK, Yorkshire Pergolas cannot guarantee that consultations, surveys or fittings will not be delayed or cancelled as a result of local lockdowns or other restrictions. Yorkshire Pergolas will endeavour to advise you of any delay as soon is reasonably practicable and to reschedule accordingly. Yorkshire Pergolas will at all times work within the government’s guidelines regarding social distancing during all appointments at your home and abide by lockdown restrictions as they occur. Failure to supply goods due to these restrictions does not constitute a breach of these terms.
  3.  All products are bespoke and made-to-measure to your requirements. As such, they fall into the category of tailor-made products under the Consumer Contracts Regulations 2013 and (subject to clauses. You will not therefore be able to cancel your order for any product(s) once placed, provided that this will not affect your legal rights as a consumer in relation to bespoke and made-to-measure products that are faulty or not as described. Notwithstanding the above clause we will accept the cancellation of your order once placed as long as your notice of cancellation is received within two calendar days starting with the date your order is placed. Our preferred method of cancellation is by email to charlie@beautifullyshuttered.co.uk or by telephone on 07939 121987 to ensure traceability. Your notice of cancellation will be deemed to have been served on and will take effect from the day it is given to us.
  4. Title and ownership of the goods shall only pass to the buyer upon Yorkshire Pergolas receiving payment in full and as such we reserve the right to repossess said goods in the event of non-payment of any outstanding balance.
  5. Balance due to be paid on satisfactory completion of work.
  6. Yorkshire Pergolas shall make all reasonable endeavours to supply the goods within this timescale but we shall not be liable to you if we are prevented or delayed in the performing of any obligations to you if this is due to any cause beyond our reasonable control including, without limitation: delays caused by our suppliers, shipping delays, an act of God, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure by you to give us a correct delivery address or notify us of any change of address.

Notice of Right to Cancel

  1. All our Pergola products  are bespoke and made-to-measure to your requirements.   3. Delays to fitting – if for any reason the buyer delays fitting of the pergola once Yorkshire Pergolas have notified the buyer of the arrival of their order then full payment will be due and must be paid within 7 days of the date the seller notifies the buyer that the order has arrived.
  4. Yorkshire Pergolas accepts no responsibility for changes in any aspect of the location and groundworks after the final measure and the order has been placed. Any goods that do not fit as a result of this will still need to be paid in full and any remakes or further work required will also be charged for.
  5. In the unlikely event that you are dissatisfied with your pergola once fitted or find any defects. You must notify Yorkshire Pergolas within 72 hours by emailing charlie@yorkshirepergolas.co.uk  or by calling Charlie on 07939 121987. We will arrange with you a suitable time to call and inspect the pergola to remedy the defect in question or re-supply the product.
